വിവാഹിതയ്ക്ക് ലൈംഗിക സ്വാതന്ത്ര്യമുണ്ടെന്ന് സുപ്രീം കോടതി

ന്യൂഡല്‍ഹി:  ഒരു സ്ത്രീയ്ക്ക് പറ്റില്ലെന്ന്  പറയാന്‍ അവകാശം ഉണ്ടെങ്കില്‍ വിവാഹശേഷം അവള്‍ക്ക്  ലൈംഗിക സ്വാതന്ത്ര്യവും ഉണ്ടെന്ന് അംഗീകരിക്കേണ്ടിവരുമെന്ന് സുപ്രീംകോടതി.  വിവാഹേതര ബന്ധത്തില്‍ ശിക്ഷ നല്‍കുന്നതുമായി ബന്ധപ്പെട്ട നിയമം പരിശോധിക്കുന്നതിനിടെയാണ് ജഡ്ജിമാരില്‍ ഒരാള്‍  ഇത്തരത്തില്‍ അഭിപ്രായപ്പെട്ടത്. ചീഫ് ജസ്റ്റിസ് ദീപക് മിശ്ര അധ്യക്ഷനായ ബെഞ്ചില്‍ അഞ്ചംഗ ജഡ്ജിമാരാണ് ഉള്ളത്.   ഒരു സ്ത്രീ വിവാഹേതര ബന്ധത്തിലേക്ക് പോകുന്നത് തന്നെ വിവാഹ ബന്ധം തകര്‍ന്നതിന്റെ സൂചനയാണെന്നും വിവാഹിതയാണെന്നതുകൊണ്ടുമാത്രം അവളുടെ ലൈംഗിക സ്വാതന്ത്ര്യം ഇല്ലാതാവില്ലെന്നും  ജസ്റ്റിസ് ചന്ദ്രചൂഡ് അഭിപ്രായപ്പെട്ടു.

ലൈംഗിക പരമാധികാരം സ്വഭാവിക അവകാശമാണെന്ന് പറയുകയാണെങ്കില്‍ വിവാഹമോചനം നേടാനുള്ള കാരണമായി അവിഹിത ബന്ധത്തെ കാണാനാകില്ലെന്ന് ചീഫ് ജസ്റ്റിസ് ദീപക് മിശ്ര കൂട്ടിച്ചേര്‍ത്തു. വിവാഹേതരബന്ധങ്ങള്‍ ക്രിമിനല്‍ കുറ്റമാകുമ്പോള്‍ തന്നെ അത് പൗരാവകാശ ലംഘനവും ആവുന്നു.  വൈവാഹിക തര്‍ക്കങ്ങള്‍ ഉണ്ടാകുമ്പോള്‍ വിവാഹമോചനം നേടാനായി ഇത് ഉപയോഗിക്കപ്പെടുന്നുമുണ്ടെന്നും ചീഫ് ജസ്റ്റിസ് കൂട്ടിച്ചേര്‍ത്തു. മാനസിക പീഡനം വിവാഹമോചനത്തിനുള്ള കാരണമായി പരിഗണിക്കാം. എന്നാല്‍ വിവാഹേതര ബന്ധത്തെയും മാനസിക പീഡനത്തെയും തുല്യമായി പരിഗണിക്കാനാകില്ലെന്നും മിശ്ര അഭിപ്രായപ്പെട്ടു.

The judges appointed by the majority community always follows the agenda and interests of the majority community. We have seen this in the USA supreme court appointments. The fight to appoint a judge is decided by political parties mostly based on party affiliation and it is natural that many judges can become partisan in their decisions. Those days where judges used to decide based on justice and principle are scarce to see. In India also judges are decided by the party that rule, especially if they can manage two third majority. Recently a judge that the panel of supreme court judges approved, the government was not ready to appoint as he was from a different religion (?) and the ruling party might not not trust him to be the judge on the supreme court. Can we say that the supreme court of a country is impartial in decisions that affect the day to day life of citizens and especially minorities? India saw some changes from the thousands of years of religious traditions when British came here and forced change. Sometimes force is only the language for some people to change their behavior.
