UNITED FORUM FOR NURSES BILL
We Demand Immediate Government Actions:

Nursing staff in private hospitals of India have been suffering great indignity and privations in
the hands of hospital managements. UNITED FORUM FOR NURSES BILL has been formed
with the initiative of various Associations working for the welfare of nurses and supported by
many social organizations and media fraternity to raise the cause of nurses. The Forum demandsUnion Governement to undertake immediate action to solve the alarming injustice the nurses are subject to, as it is imperative for patients also:

A. Government should declare Healthcare sector as INDUSTRY OF NATIONAL IMPORTANCE and make rules setting standards governing treatment of patients and service standards for employees.

B. Considering the academic prerequisites and admission process in governemnt aided colleges and the curriculum and duration of Nursing study, B.Sc Nurses’ salary at entry level should be set at 75% of average entry level salary of MBBS doctors in the same hospital. GNM nurses who perform equal work should be paid equal salary as B.Sc nurses.

C. In view of the special features of healthcare sector, there is no uniform law to govern the
health sector. Existing labour laws are misinterpreted or overlooked by hospital
managements for their own interest and nurses are not able to comprehend their labour
law rights. We demand government to introduce Bill in the Parliament to formulate
comprehensive central legislation to govern nursing workers throughout India covering:-
a. Fixation of minimum wages for all nurses working in private hospitals, charitable
hospitals, nursing homes, clinics, health tourism homes, industries, institutions
and contract sectors. Quantum of minimum wages should be fixed after
considering government salaries of the same category, new market economy
orientation of healthcare sector, social importance of the healthcare worker, etc.

b. Rules for periodic revision of salaries without fail in all the above sectors. c. Abolishing of Bond practice and with-holding of certificates of nurses, other instruments such as signed cheque or cut-back from salaries, and make provision for strict penal measures for those who violate such rules. d. Making provision for recruitment of male nursing staff mandatory by at least 30% in each hospital.

e. Ensuring adequate pay for overtime work and double pay for double duties. Employer should provide break to rest, meals and provide arrangements for refreshments while the nurse is required to do overtime duty.

f. For social security, welfare measures, workplace safety and transportation, etc.

g. Providing for convenient and quality hostel accommodation to bachelor nurses and family accommodation to married nurses in hospitals, nursing homes, health tourism, ayurvedic treatment homes, other companies, etc.

h. Providing for healthcare safety and protective measures, including vaccination, orientation classes, diseases and free medication, hospitalization in case diseases or reimbursement if the nurse has to take the treatment from another hospital.

i. Providing for medical insurance to immediate family members of the nurse.

j. Providing for 30 days annual leave with full pay, medical leave, casual leave, maternity benefits and maternity leave and leave travel concession to nurses in hospitals, nursing homes, health tourism, ayurvedic treatment homes, other companies, etc.

k. Making it mandatory to issue proper contract of employment, change of terms and
conditions, salary revisions, and all types of policy changes on the part of employer which islikely to affect the employees, in writing.

l. Form separate regulatory board or enforcement authority for the enforcement of the above provisions in central and state labour department offices. D. Since healthcare service is as important as national security and such facility is available for soldiers, Indian Railways should provide NURSES QUOTA reservation and their family members to travel from hometown to workplace. E. Labour Ministry should engage effective mechanism to safeguard nurses from being cheated by recruiting agents. F. Indian Nursing Council Act should be amended to insulate the serious drawbacks in the conduct of Nursing Schools and Colleges. It should also re-engineer the present machinery for implementation of the provision of that Act.
